Neither legal nor illegal?

In some countries, they are neither legal nor illegal due to a grey area in the legal system. It usually concerns the definition of what betting and gambling are. In many countries, horse racing isn’t explicitly contrary to the act of betting due to religion or regulation but is frowned upon.
